Cycling Accident in Essex

I have now successfully settled another personal injury case involving a cyclist.

The claim for personal injury arose after my client was thrown from his bicycle after coming into contact with a defect in the road in Harlow, Essex.

As a result of the accident my client suffered damage to several teeth including the loss of a front tooth as well as suffering bruising and scarring to his arms and face.

Tripping Accident in Hertfordshire

Garden House Solicitors have recorded another successful case at Trial in relation to a tripping accident which occurred on premises owned and controlled by a Local Government Council in Hertfordshire.

The accident occurred in December 2007 and was as a result of insufficient lighting at the Council’s premises which caused the Claimant to fall into an open ditch.

The Claimant suffered back injuries as a result of his fall and instructed a firm of solicitors to pursue the matter on his behalf. The claim was denied and the Claimant advised that he had no hope of receiving compensation or recovering his financial losses for the medical treatment he paid for himself.

A Lasting Power of Attorney lets you appoint someone who knows your business well to manage it if you’re not able to. Your business may have taken years to build up, in just a short month it could be wiped away which is a waste.

Where a client lacks mental capacity sufficient to create a will, a statutory will may be created on their behalf through the Court of Protection. This entails making an application to the court and asking them to execute a will. The application may be made by an authorised person, such as and attorney (acting under a lasting power of attorney), a deputy, or someone entitled to receive a benefit under the will. Once a statutory will is executed by the court this acts in the same way as a regular will drafted by a client.

What is the Court of Protection?

The Court of Protection is an institution based in London.  It helps to look after vulnerable adults who lack sufficient mental capacity to make decisions for themselves.                                                        

Is the Office of the Public Guardian (OPG) the same as the Court of Protection?

The two institutions are separate but both work with vulnerable adults.  The simplest explanation is that the Court of Protection makes decisions whilst the Office of the Public Guardian handles registration of powers of attorney and ongoing administration matters.
